Earlier this week, I was on Newstalk’s Lunchtime Live with Andrea discussing this. It’s worth unpacking — because this isn’t entertainment news.
It’s a signal.
What Actually Happened

She moved to trademark:

- Specific phrases
- A pose
- Even elements of her visual identity
Let that land.
Not the output.
The identity behind it.

Why This Matters Now
AI has changed the game.
It is now trivial to:
- Clone a voice
- Replicate a writing style
- Generate a realistic likeness
- Attach your identity to things you never said or did
This isn’t emerging. It’s already here.
And most leaders are still thinking in terms of content protection.
That’s outdated.
Copyright Is Not Enough
Copyright was built for a different world.
It protects:
- Songs
- Articles
- Images
It does not protect:
- Tone
- Style
- Presence
- Identity signals
AI doesn’t need to copy your work anymore.
It can generate something new that feels like you.
That’s where copyright breaks down.
Trademark Is the Real Move
Trademark law is built for this moment.
It focuses on:
- Brand identity
- Market confusion
- “Confusingly similar” representations
That last point matters.
You don’t need an exact copy to create damage.
You just need something close enough to mislead.
That’s the world we’re now operating in.
This Is Not a Celebrity Issue
If you are:
- A CEO
- A founder
- A keynote speaker
- A visible leader
You already have a digital footprint.
Which means you already have exposure.
Here’s the reality:
- Your voice can be cloned from minutes of audio

What This Means in Practice
This is where most organisations are behind.
1. Treat Your Identity as an Asset
Your voice, tone, and presence are no longer soft factors.
They are strategic assets that need protection.
2. Audit Your Exposure
- How much of your voice is publicly available?
- How consistently do you communicate?
- Could someone replicate you convincingly?
If the answer is “yes,” you have a gap.
3. Define Your Signature
What makes you recognisable?
- Language patterns
- Core messages
- Delivery style
- Visual cues
This is what needs to be protected.
4. Explore Legal Protection
You don’t need celebrity-scale legal teams.
But you do need awareness:
- What can you trademark?
- What protections exist for likeness and voice?
- Where are the gaps?
Ignoring this is no longer an option.
5. Build a Response Protocol
Assume this will happen at some point.
- Who responds?
- How quickly?
- On which channels?
If you don’t have a plan, you will react too slowly.
6. Educate Your Audience
This is underused.
The clearer your audience is on:

- Where you communicate

…the harder it becomes to mislead them.

We are moving from:

And most leaders haven’t caught up.

Your reputation is now:

AI has made identity fluid.
The question is no longer:
“How do we use AI?”
It’s:
“How do we protect ourselves in a world where AI can be us?”
That’s the shift Swift just accelerated.
And it applies far beyond the stage.
